A sessions court acquitted a accused of kidnapping case on the ground that when the child was kidnapped in 1997, he was of 3yrs and at the age of 11 in 2008 he was examined first time in the court. The sessions court plea was that a 3yr old child cannot remember his kidnapper's after the lapse of 7 years.
some important questions are-
1. court needs evidence and witness so court has no right to reject the victim's witness.
2. if 3 yrs old child can recognize their parents, he will recognize the kidnappers.
